船舶戰(zhàn)爭、罷工險條款
一九八六年一月一月
一、責(zé)任范圍
本保險承保由于下述原因造成被保險船舶的損失、碰撞責(zé)任、共同海損和救助或施救費(fèi)用：
（一）戰(zhàn)爭、內(nèi)戰(zhàn)、革命、叛亂或由此引起的內(nèi)亂或敵對行為；
（二）捕獲、扣押、扣留、羈押、沒收或封鎖，但這種賠案必須從發(fā)生日起滿六個月才能受理；
（三）各種戰(zhàn)爭武器，包括水雷、魚雷、炸彈；
（四）罷工、被迫停工或其他類似事件；
（五）民變、暴動或其他類似事件；
（六）任何人懷有政治動機(jī)的惡意行為。
二、除外責(zé)任
由于下列原因引起被保險船舶的損失，責(zé)任或費(fèi)用，本保險不負(fù)賠償責(zé)任：
（一）原子彈、氫彈或核武器的爆炸；
（二）由被保險船舶的船籍國或登記國的政府或地方當(dāng)局所采取的或命令的捕獲、扣押、扣留、羈押或沒收；
（三）被征用或被征購；
（四）聯(lián)合國安理會常任理事國之間爆發(fā)的戰(zhàn)爭（不論宣戰(zhàn)與否）。
三、保險終止
（一）保險人有權(quán)在任何時候向被保險人發(fā)出注銷本保險的通知，在發(fā)出通知后7天期滿時生效；
（二）不論是否已發(fā)注銷通知，本保險在下列情況下應(yīng)自動終止：
1．任何原子、氫彈或核武器的敵對性爆炸發(fā)生；
2．聯(lián)合國安理會常任理事國之間爆發(fā)的戰(zhàn)爭（不論宣戰(zhàn)與否）；
3．船舶被征用或出售。
四、承保原則
（一）本保險系本公司船舶保險的附加險。船舶保險的條款也適用本保險，但與本保險條款有抵觸時．則以本保險條款為準(zhǔn)
（二）被保險船舶如同時有其他保險，任何索賠應(yīng)由其他保險負(fù)責(zé)時，本保險不負(fù)賠償責(zé)任。
（三）如本保險由于第三條的原因終止時，凈保費(fèi)可按日比的退還給被保險人。本保險不辦理停泊退費(fèi)。
HULL WAR AND STRIKES CLAUSES1/1/86
I Scope of cover
This Insurance covers loss of or damage to or collision Liability of or expense arising from general average or sue and labour of the insured vessel caused by:
1. War, civil war, revolution, rebellion or civil Strife arising therefrom, or any hostile act;
2. Capture, seizure, arrest, detainment, confiscation or blockade, but such claim shall be dealt with only on expiry of six months from the day when such events arise,
3. Any weapons of war including mines, torpedoes or bombs
4. Strikes, lock-outs or other similar events;
5. Civil commotions, riots or other similar events;
6. Any person acting maliciously from a political motive.
II Exclusions
This insurance does not cover loss, damage, liability or expense arising from:
1. Atomic or hydrogen bombe or nuclear weapons of war;
2. Capture, seizure, and, detainment or confiscation by or under the order of the government or local authority of the country in which the vessel is owned or registered;
3. Requisition or pre-emption,
4. The outbreak of war (whether there be a declaration of war or not) between any countries which are permanent members of the Security Council of the United Nations.
III Termination
l. The Insurer shall be entitled to issue to the Insured at any time notice of cancellation to terminate this insurance upon expiry of seven days from the day on which the notice is issued;????
2. Whether or not such notice of cancellation has been given, this insurance shall terminate automatically;
l) Upon the occurrence of any hostile detonation of atomic or hydrogen bombe or nuclear weapon of war;
2) Upon the outbreak of war (whether there be a declaration of war or not) between any countries which are permanent members of the Security Council of the United Nations;
3) In the event of requisition or sale of the vessel.
IV General Conditions
l. This insurance is an additional insurance to the Hull Insurance of this Company. In case of conflict between any clauses under this Insurance and the Hull Insurance, the clause under this Insurance shall prevail;
2. This insurance shall not be liable for any claim which would be recoverable under any other insurance but for existence of this insurance;
